Relocations of distance selling pharmacy contracts are starting to become more common as new businesses expand and seek new premises. The nature of a distance selling pharmacy contract does not affect the test that is applied by the NHS in considering the relocation, but the facts about how the pharmacy operates can make a big difference to the distance that the contract can be moved over. In this case our client wanted to not only relocate to bigger premises, but also move over 10 miles and to a completely different Health and Wellbeing Board area. We were able to show that, despite the significant distance involved (which we believe may be the furthest relocation ever approved), the application still met all the tests as set out in the Regulations and should be approved. NHS England agreed with us and the application has now received final approval.
