Relocation of Distance Selling Contract Over 10 miles

Relocations of distance-selling pharmacy contracts are starting to become more common as new businesses expand and seek new premises. The nature of a distance-selling pharmacy contract does not affect the test the NHS applies in considering the relocation, but the facts about how the pharmacy operates can make a big difference to the distance that the contract can be moved over. In this case our client wanted to not only relocate to bigger premises, but also move over 10 miles and to a completely different Health and Wellbeing Board area.

We were able to show that, despite the significant distance involved, the application still met all the tests as set out in the Regulations. This meant that it should be approved. (We believe this may be the furthest relocation the NHS has ever approved). NHS England agreed with us; the application has now received final approval.
